Lawyer Conflict of Interest Software
PRODUCTS - Conflict Avoidance
In an age where mergers
and acquisitions are commonplace, law
firms have an increasingly difficult
time deciding whether potential customers
represent a conflict of interest for
the firm. FSLI’s Conflict Avoidance module is a conflict
of interest software that provides
a systematic and thorough approach to
testing a new entity’s conflict
potential. PD Partner allows your
firm to formally, or informally, search
its active and historic client base,
related parties and even related party
biographical information to discover
potential conflict situations.
Power: Every client and matter in the PD Partner system is
automatically flagged for conflict checking.
The integration with the time
and billing software module is real-time
(no
re-keying of data). Each
case may have an unlimited number of
related parties, all of which are automatically
included in conflict searches.
This thorough approach to conflict indexing
ensures maximum protection against taking
on a new case where a conflict exists.
Speed: PD Partner’s Conflict Avoidance system uses a
set of indexed tables to store every
key word and its relationship to a file
or party. When searches are performed,
they are run against these indexed tables
as opposed to the traditional full text
search. The result, search hits
are retrieved in seconds rather than
minutes, even on large databases.
Flexibility: The Conflict
Avoidance system was designed to
support both informal searches and formal
case intake searches. From his
or her desk, an attorney can simply
type in a Company Name or an individual’s
SSN and peruse any potential hits.
These informal searches DO NOT add data
to the conflict tables unnecessarily.
However, when a case intake person opens
a matter or creates a conflict record,
the data is written directly to the
conflict system for future searches.
Above all else, the system was designed
to be adaptive, to works the way your
firm works. Some firms prefer
to enter a formal conflict search first
to test the waters, then associate all
conflict material with a Time
and Billing software file if opened.
Other firms prefer to start with a matter
and build from there. PD Partner’s
Conflict Avoidance system works equally
well in either scenario.
Searching: Boolean logic allows your firm to define the information you are seeking and narrow the criteria. Logical relationships between terms are expressed by the connectors NEAR and ADJACENT. For example, searching for “asbestos adjacent to litigation” will find instances where the words “asbestos” and “litigation” appear together. Using the NEAR operator with these two words will return all records where these two words exist in the same data field in a record.
Your firm may also limit searches by defining the maximum number of matches per keyword and per search. Also, initial search results may be further narrowed online by removing certain search criteria and having immediate access to the new list of “matches” or “hits”.
By providing the firm with controls
to refine and restrict searches, PD
Partner's Conflict system can
be used to dissect very large databases
with precision to uncover potential
lawyer
conflict of interest issues.
Result: The power, flexibility and ease-of-use of PD Partner’s
Conflict Avoidance System will provide
your firm with a reliable mechanism
to assess the potential conflict probability
of any new party. The firm will
be able to confidently decide on new
business opportunities. Finally,
your firm will be able to move the business
forward to new levels of performance
without the constant worry of a lawyer
conflict of interest law suit.
